Ugly Mugz Privacy Policy

Ugly Mugz ("Ugly Mugz," "we," "us," or "our") is a brand operated by CPASoft, Inc. This Privacy Policy explains what information we collect when you visit https://ugly-mugz.com (the "Site") or interact with us, how we use it, and the choices you have. By using the Site, you agree to the practices described in this policy.
Personal Information We Collect
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as "Device Information."
We collect Device Information using the following technologies:
- Cookies are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit allaboutcookies.org.
- Log files track actions occurring on the Site, and collect data including your IP address, browser type, internet service provider, referring and exit pages, and date and time stamps.
- Web beacons, tags, and pixels are electronic files used to record information about how you browse the Site.
When you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as "Order Information."
If you opt in to receive SMS messages, we collect your mobile phone number and a record of your consent. See the SMS / Mobile Messaging Program section below.
When we talk about "Personal Information" in this Privacy Policy, we are referring to Device Information, Order Information, and any mobile messaging information we collect.
How We Use Your Personal Information
We use the Order Information that we collect generally to fulfill any orders placed through the Site, including processing your payment, arranging for shipping, and providing you with invoices and order confirmations. Additionally, we use Order Information to:
- Communicate with you about your order, account, and inquiries;
- Screen our orders for potential risk or fraud; and
- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
We use Device Information to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize the Site, including by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns. We may also use Device Information and browsing behavior for retargeting.
We use mobile messaging information solely to operate our SMS messaging program as described below.
Sharing Your Personal Information
We share your Personal Information with third parties to help us use your Personal Information as described above. For example, we use Shopify to power our online store. We may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights.
Notwithstanding the above, we do not share, sell, rent, or otherwise transfer mobile phone numbers, SMS opt-in status, or SMS consent records to any third parties or affiliates for their own marketing purposes. See the SMS / Mobile Messaging Program section below for details on how mobile information is handled.
Behavioural Advertising
As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. We do not use mobile phone numbers or SMS consent records for behavioural advertising or targeted marketing.
SMS / Mobile Messaging Program
Ugly Mugz, a DBA of CPASoft, Inc., operates an SMS messaging program. By providing your mobile phone number and opting in, you consent to receive SMS messages as described in this section.
Opt-in
We collect mobile numbers and SMS consent only when you affirmatively opt in. Opt-in is offered in two places: the live chat widget on ugly-mugz.com and the checkout flow on ugly-mugz.com. At each opt-in point, you may independently consent to (a) customer care messaging and (b) promotional messaging through separate, unchecked checkboxes. Consent for marketing messages is never bundled with consent for transactional messages, and consent for either is never required to make a purchase.
Message types
Customer care messages may include responses to support requests, order and shipping updates, ticket updates, appointment coordination, and follow-ups tied to an existing inquiry. Promotional messages may include limited-time offers, discounts, event announcements, and product news.
Frequency
Message frequency varies by your activity and is typically fewer than 10 messages per month per recipient.
Cost
Message and data rates may apply. Charges are billed by your mobile carrier and are your responsibility.
Help and opt-out
Reply HELP at any time for help. Reply STOP at any time to opt out of future messages from the program you joined. After STOP, you will receive one confirmation message and no further messages from that program.
Privacy of mobile information
We do not share, sell, rent, or otherwise transfer mobile phone numbers, SMS opt-in status, or SMS consent records to any third parties or affiliates for their own marketing purposes. We use this information only to operate our own messaging program. We may share mobile information with service providers who help us operate the program, for example our messaging platform and telecom carriers, strictly for that purpose and under contractual confidentiality and security obligations.
Carriers
Carriers are not liable for delayed or undelivered messages.
Data Retention
We retain Personal Information for as long as necessary to provide our products and services, comply with legal obligations, resolve disputes, and enforce our agreements. When you place an order through the Site, we will maintain Order Information for our records unless and until you ask us to delete this information. SMS opt-in records are retained for the duration of your consent and for a reasonable period afterward to demonstrate compliance with applicable laws.
Your Rights and Choices
Depending on where you live, you may have rights to access, correct, or delete personal information we hold about you, to object to or restrict certain processing, to receive a copy of your data in a portable format, and to withdraw consent at any time where processing is based on consent.
California residents
Under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), you have additional rights including the right to know, the right to delete, the right to correct, and the right to opt out of the sale or sharing of personal information. We do not sell personal information for money. We may share certain Device Information with advertising partners for cross-context behavioural advertising, which California law treats as "sharing." You can opt out of this sharing using the links in the Behavioural Advertising section above, or by contacting us. We do not discriminate against you for exercising any of your rights.
European Economic Area, United Kingdom, and similar jurisdictions
If you are located in the European Economic Area, the United Kingdom, or another jurisdiction with similar data protection laws, we process your Personal Information on the following bases: performance of a contract (to fulfill your order), consent (for marketing messages and certain cookies), legitimate interests (to operate and improve our business), and compliance with legal obligations. You have the rights described above and the right to lodge a complaint with a supervisory authority.
Marketing email opt-out
You can opt out of marketing emails by clicking the unsubscribe link in any marketing email or by contacting us using the details below.
SMS opt-out
Reply STOP to any program message.
To submit a request to exercise your rights, contact us using the details in the Contact Us section. We may need to verify your identity before responding.
Children's Privacy
The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us using the details below and we will take appropriate steps to delete the information.
Security
We use reasonable administrative, technical, and physical safeguards designed to protect Personal Information. No method of transmission over the internet or electronic storage is fully secure, and we cannot guarantee absolute security.
International Data Transfers
We are based in the United States. If you access the Site from outside the United States, your information may be transferred to, stored, and processed in the United States or other countries that may have different data protection laws than your country. Where required, we use appropriate safeguards for cross-border transfers.
Do Not Track
Please note that we do not alter the Site's data collection and use practices when we see a Do Not Track signal from your browser.
Changes
We may update this Privacy Policy from time to time to reflect changes to our practices or for other operational, legal, or regulatory reasons. When we make material changes, we will update the Effective Date above and, where appropriate, notify you through the Site or by email.
